CALABASH
HOA GUIDE

THE SHORT ANSWER
Calabash has both HOA communities and homes with no HOA, and neither is better for everyone. An HOA means dues and private rules, and in return the association handles shared spaces. No HOA means fewer private rules, but town zoning still applies. Read the documents for the exact home before you decide.
Before I came back to real estate, I spent about 20 years in high-end restaurant and bar service. One habit stuck with me. Ask what is included before you order. HOA dues work the same way, and I walk my buyers through the line items.
What is the NC Planned Community Act?
It is the state law that sets ground rules for most HOAs in North Carolina. It is Chapter 47F of the NC General Statutes. Here is who it covers:
- It fully applies to planned communities created on or after January 1, 1999.
- It does not apply to newer communities with 20 or fewer lots, unless the community’s declaration opts in.
- Some sections also apply to older communities. These include the rules on assessments, liens, meetings and association records.
- An older community can choose full coverage by amending its declaration. That generally takes a vote of owners holding at least 67% of the votes.
The age of the community matters. Ask when it was created, and have your attorney confirm which rules apply.
What do HOA dues cover in Calabash?
It depends on the community, so read the budget instead of guessing. Dues might pay for common area upkeep, an amenity center or road care. Some cover more and some cover less.
Here is one real example. In MLS data I pulled in September 2026, the main association fee for Brunswick Plantation, in the Calabash area, was $1,176 per year. Fees change, and some communities have more than one association. Always confirm current dues with the association.
North Carolina’s seller disclosure form helps here. State law requires a separate owners’ association section when a home is in an HOA. It asks for:
- The association’s name and contact information
- Regular dues and any special assessments
- The services the dues pay for
- Any pending lawsuits or unpaid judgments against the association
- Any fees charged when the home is sold

What happens if HOA dues go unpaid in NC?
Unpaid dues can turn into a lien on the home. Under the Planned Community Act, an assessment unpaid for 30 days or more can become a lien once the association files a claim of lien with the clerk of superior court. In some cases, after 90 days unpaid and a board vote, the association can move toward foreclosure.
For buyers, this is why the closing matters. The association must give a statement of unpaid assessments within 10 business days of a written request from the owner or the owner’s agent. Your closing attorney uses it to make sure old dues are paid before the home becomes yours.
How do I get the HOA documents before I buy?
Ask for them early, ideally before your due diligence period ends. Here is what I ask for:
- Declaration of covenants. This holds the main rules, such as rental limits, fences, parking and exterior changes.
- Bylaws. These explain how the board runs and how votes work.
- Rules and regulations. These are the day-to-day rules.
- Budget and financials. Under state law, the association must give owners a yearly income and expense statement and a balance sheet within 75 days after its fiscal year ends.
- Meeting minutes. These can show planned projects or disputes.
The seller is the owner, so the seller or the listing agent can usually request these. Owners have the right to examine association records under the Act.
What rules apply if a Calabash home has no HOA?
Inside town limits, the Town of Calabash Unified Development Ordinance applies. The version I checked is dated May 24, 2010, with amendments through March 11, 2025. It sets zoning districts and building rules. For example, a detached garage or carport must meet the same setbacks as the main house.
Two more points matter here:
- Private restrictions can still exist. The ordinance says it does not cancel private covenants. Where the ordinance is stricter, the ordinance controls. A home with no HOA can still have recorded restrictions, and your attorney’s title search should find them.
- Check town limits. Some homes with a Calabash address may sit outside town limits, where county rules apply instead. Confirm which applies to the lot.
Before you plan a shed, fence or boat parking spot, call the town about the exact address.
