SELLING DURING PROBATE

Last updated October 2026

THE SHORT ANSWER

Often, yes, but someone with legal authority has to sign. In both North Carolina and South Carolina, the estate's personal representative (the executor or administrator) usually signs the deed. Whether they need court approval depends on what the will says. Heirs can clean out, insure and care for the home and talk to a listing agent, but a buyer's title company will want to see the estate paperwork before closing.

01

Who Can Sell a House When the Owner Has Passed Away?

Usually the personal representative of the estate. That person is named in the will (an executor) or appointed by the court (an administrator). Once appointed, they receive official papers:

  • North Carolina: Letters Testamentary or Letters of Administration from the Clerk of Superior Court in the county where the person lived
  • South Carolina: a Certificate of Appointment from the county Probate Court, such as Horry County Probate Court

A title company will almost always ask for these papers before a sale can close.

02

Can You Sell a House Before Probate Is Finished in North Carolina?

Yes, in many cases.

  • If the will gives the personal representative the power to sell, they can usually sell without a court hearing.
  • If the will does not, or there is no will, the personal representative usually asks the Clerk of Superior Court for permission through a special proceeding.
  • Heirs who sell on their own, without the personal representative, can run into problems during the first 2 years after death if notice to creditors is published. In that window, buyers and title insurers usually want the personal representative to sign too.
03

Can You Sell a House Before Probate Is Finished in South Carolina?

Yes, often during the estate process.

  • If the will gives the personal representative the power to sell, they can usually deed the home directly to a buyer.
  • If not, a sale usually needs the heirs' agreement or court approval.
  • If the home is not sold, it can pass to the heirs by a Deed of Distribution, and the heirs can sell after that.
  • Estates selling through a personal representative are exempt from the SC seller disclosure form, but you still should not hide known problems.
04

How Long Does Probate Take in SC and NC?

Plan on several months at least. In SC, creditors have 8 months from the first newspaper notice to file claims, and many estates close 8 to 12 months after that notice. NC also has a creditor period after notice is published. A sale can often happen during this time once the personal representative is appointed.

What Can Heirs Do Before Probate Is Done?

  • Secure the home. Change locks if needed and keep it locked.
  • Keep insurance active. Tell the insurer the owner has passed. A vacant home may need a different policy.
  • Keep up the basics. Mow, keep power on, and watch for leaks.
  • Remove personal items with the personal representative's OK.
  • Get a value. Knowing the price helps the family decide whether to sell, keep or rent.
  • Talk to an estate attorney before signing any listing or sales contract.
QUESTIONS PEOPLE ASK

Frequently Asked Questions

Can you sell a house if it has not gone through probate?

Usually someone needs authority from the court first, such as an appointed personal representative. Once appointed, they can often sell before the estate is fully closed.

Can an executor sell property without the heirs agreeing?

It depends on the will and state law. If the will gives a power of sale, the executor may be able to sell. If not, they may need the heirs' consent or court approval.

Can you clean out a house before probate?

Yes, with the personal representative's agreement. Keep a list of valuables and do not sell or give away items until the estate is sorted out.

Do you need a seller disclosure form when selling an estate home in SC?

SC exempts personal representatives selling during estate administration from the disclosure form. Disclose known problems anyway.

How long after death can a house be sold in NC?

Often within a few months, once a personal representative is appointed. Sales by heirs without the personal representative can be risky in the first 2 years.
